Terms of Service

Welcome to BringWhat ("we", "us", "our"). These Terms of Service ("Terms") are an agreement between you and BringWhat for your use of bringwhat.com (the "Service"). By creating an account, responding to an invitation or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Please read Section 5.1, which releases claims against BringWhat over food, allergies and events, including claims that BringWhat was negligent, and Sections 12 to 14, which limit what BringWhat is responsible for and what it can be held liable for.

1. Eligibility

You must be at least 13 years old to create an account or use the Service. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or guardian, who agrees to these Terms on your behalf.

2. Accounts

• You are responsible for keeping your login credentials confidential and for activity under your account.
• You agree to provide accurate, current information when creating an account.
• You must verify your email address. Accounts that remain unverified are forfeited and deleted as described in Section 15.1.
• You may not create accounts on behalf of others without their consent.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Harass, abuse, threaten or harm other users, or impersonate anyone.
• Post content you do not have the right to share, or other people's personal or health information without their permission.
• Transmit spam, chain letters, or unsolicited mass communications.
• Attempt to gain unauthorized access to any part of the Service, or scrape or harvest data from it.
• Interfere with or disrupt the integrity or performance of the Service.
• Circumvent rate limits, usage caps, or other technical restrictions.

4. Your Content

• You keep ownership of the content you post, such as event details, item names, messages and images.
• You give BringWhat a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, crop, format and display your content, and to show it to the people you share it with, solely to operate and improve the Service. The license ends when you delete the content or your account, except for copies in backups, which expire within 30 days, and copies others have already received, such as in an email.
• Content you add to someone else's event, such as an item on its list, may stay on that event after you leave it or delete your account, without your name.
• You are responsible for your content, and you confirm you have the rights needed to post it, including permission from people who appear in your photos.
• We do not pre-screen content but may remove material that violates these Terms.

5. Food, Allergies & Gatherings

BringWhat helps people plan who brings what. We do not cook, inspect, label or deliver food, and we do not host, attend or supervise events.

• Allergy information comes from guests themselves. We do not check it, it may be incomplete or out of date, and a list without names cannot tell you who needs what. A warning that a dish may contain an allergen is an automated guess based on the dish's name, not a check of its ingredients, and the absence of a warning does not mean a dish is safe.
• Whoever prepares, brings or serves food is responsible for it, including its ingredients, safe handling and telling others what is in it.
• If you have a food allergy, ask about ingredients directly and do not rely on BringWhat to keep you safe. In an emergency, call 911 or your local emergency number.
• Events are arranged between hosts and guests. BringWhat is not a party to those arrangements and, to the extent the law allows, is not responsible for what happens at an event, including illness, injury or damage to property.

6. Advertising & Affiliate Links

• Event pages and blog posts may display curated product suggestions. These are chosen from our own catalog based on the event's item list or the post's topic, not by a third-party advertising network, and not based on your personal data or browsing activity.
• Some suggestions link to third-party retailers (such as Amazon or Instacart) through affiliate programs. BringWhat may earn a commission on qualifying purchases made through these links, at no additional cost to you.
• We are not responsible for the products, pricing, availability, or business practices of any third-party retailer linked from the Service. Purchases from a third-party retailer are subject to that retailer's own terms and policies.
• See our Privacy Policy for more information about how product suggestions are selected.

7. Guest Invitations & Email

• When you invite a guest, BringWhat may send an email on your behalf if you choose the send-email option. Invited guests may also receive emails about the event, such as reminders, which they can turn off.
• You represent that you have a reasonable basis to contact each person you invite (e.g. a personal or social relationship).
• Abuse of the invitation system (spam, bulk invites to strangers) is prohibited and may result in account suspension.

8. Rate Limits & Fair Use

To protect all users, we enforce reasonable usage limits including, but not limited to:

• Maximum number of guest invitations per event.
• Maximum number of events created per day.

Accounts that repeatedly exceed these limits may be flagged for review and temporarily or permanently restricted.

9. Privacy

Our Privacy Policy describes how we collect, use and protect your information, and our Consumer Health Data Privacy Policy covers the allergies you choose to add to your profile.

10. Cookies

The Service uses essential cookies to keep you signed in and secure. Analytics cookies are set only if you accept them in the cookie banner. See the Privacy Policy for details.

11. Copyright Complaints

If you believe content on the Service infringes your copyright, email support@bringwhat.com with "Copyright" in the subject, or write to the address in Section 19, and include:

• your physical or electronic signature;
• the copyrighted work you believe is infringed;
• the material you want removed and where it appears on the Service, such as its web address;
• your name, address, telephone number and email address;
• a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; and
• a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

We will remove material that a valid notice identifies. If your content was removed and you believe that was a mistake, you may send a counter-notice. We will end the accounts of people who repeatedly infringe.

15. Termination

You may delete your account at any time from your Account Settings. It is permanently erased after a three-day recovery window, as the Privacy Policy describes. We may suspend or end your access if you violate these Terms, if the law requires it, or to protect the Service or other people, and we will try to tell you why when it is appropriate. Sections 4 (for content in backups), 5, 12, 13, 14, 17 and 18 continue after your account ends.

15.1 Unverified Email Addresses

Verifying your email address is required to maintain an account. If your address remains unverified, we will contact you at that address on the following schedule, measured from the day the account was created:

• On sign-up — a verification email.
• After about 30 days — a reminder to verify.
• After about 60 days — a final notice, stating the date on which the account will be deleted.
• After about 83 days — the account is marked for deletion and enters a seven-day final window, during which access to your account settings is restricted.
• After about 90 days — the account is forfeited and permanently deleted, along with the content associated with it.

You can stop this process at any point before the deletion date by verifying your email address, which cancels the scheduled deletion immediately. Verification is the only way to restore an account marked for deletion under this section: because the account was marked precisely for want of a verified address, it cannot be reinstated on request while the address remains unverified. You may request a fresh verification email at any time.

The verification link remains valid for as long as the account does, so any of the emails above may be used to verify and restore it at any time before the deletion date. Deletion under this section is permanent and cannot be reversed once carried out. See our Privacy Policy for what erasure involves.

16. Changes to These Terms

We may update these Terms from time to time. Before a material change takes effect, we will notify registered users by email or with a notice in the Service. The version and publish date at the top show which version this is. If you keep using the Service after a change takes effect, the updated Terms apply to you. If you do not agree to them, you may delete your account.

17. Governing Law & Disputes

These Terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. Any claim that is not resolved will be brought only in the state or federal courts located in Bexar County, Texas, and you and BringWhat consent to those courts' jurisdiction, except that either of us may bring a qualifying claim in small claims court. Nothing in this section takes away any protection you have under the mandatory consumer laws of the place where you live.

18. General

These Terms, together with the Privacy Policy and the Consumer Health Data Privacy Policy, are the entire agreement between you and BringWhat about the Service. If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a provision, that is not a waiver of it. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of the Service.
